By downloading, installing, or using the First Then Board application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms are a legal agreement between you and ChipTech LLC ("ChipTech," "we," "our," or "us").
First Then Board is a visual communication application designed to support children and individuals in ABA therapy, speech therapy, and related programs. The App allows users to create and display visual "First/Then" boards using PECS-style picture cards, custom images, and scheduled board routines.
The App is intended for use by parents, guardians, caregivers, educators, and licensed therapists. It is not a medical device and does not provide clinical or therapeutic advice.
Subject to these Terms, ChipTech grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial purposes.
You may not:
You may add custom photos and labels to the App ("User Content"). You retain ownership of all User Content you create. By using the App, you represent that you have the rights to any photos or content you add and that your User Content does not violate any third-party rights or applicable laws.
User Content is stored locally on your device. ChipTech does not access, store, or transmit your User Content.
The App is free to download and includes core features at no cost. Additional features may be available through in-app purchases or a premium plan.
All content, design, code, and trademarks within the App — except User Content — are the property of ChipTech LLC and are protected by copyright, trademark, and other intellectual property laws. "First Then Board," "ChipTech," the ChipTech logo, and related marks are trademarks of ChipTech LLC. You may not use these marks without prior written permission.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. CHIPTECH DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR REQUIREMENTS. CHIPTECH EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHIPTECH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. IN NO EVENT SHALL CHIPTECH'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO CHIPTECH IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
First Then Board is a communication support tool. It is not a substitute for professional medical, therapeutic, or clinical advice. Always consult a qualified healthcare provider or licensed therapist regarding your child's specific needs.
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, if you violate these Terms. You may stop using the App at any time.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the state in which ChipTech LLC is registered, without regard to conflict of law principles.
